1. Agreement to Terms

By downloading, installing, or using the Verdi - Plant Identifier application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and Digitix LLC ("Company," "we," "us," or "our").

2. Description of Service

Verdi - Plant Identifier is a mobile application that provides:

  • AI-powered plant identification from photos
  • Plant disease diagnosis and health analysis
  • Insect and pest identification
  • Personalized plant care recommendations
  • Water calculator and watering reminders
  • Light meter for optimal plant placement
  • Local weather information for plant care

3. User Accounts and Subscriptions

3.1 Free Features

The App offers limited free features including a daily limit of plant identifications, water calculator, and care reminders.

3.2 Premium Subscription

Verdi Premium provides unlimited access to all features. By subscribing:

  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Subscription automatically renews unless cancelled at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel subscriptions in your App Store account settings
  • Any unused portion of a free trial period will be forfeited when purchasing a subscription

3.3 Free Trial

We may offer a free trial period for Premium features. After the trial ends, you will be automatically charged for the subscription unless you cancel before the trial period ends.

4. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the App for any illegal or unauthorized purpose
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Remove or alter any proprietary notices or labels
  • Use the App to transmit any malicious code or harmful content
  • Interfere with or disrupt the App or servers connected to the App
  • Use automated systems to access the App without our permission
  • Resell or redistribute the App or its content

5. Intellectual Property

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, and the design) are owned by Digitix LLC and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

  • Plant identifications will be 100% accurate
  • Disease diagnoses will be medically or scientifically precise
  • Care recommendations will guarantee plant health or survival
  • The App will be uninterrupted, error-free, or secure

Important: The App is intended for informational and educational purposes only. Plant identifications and care recommendations should not be used as the sole basis for decisions regarding plant health, especially for plants that may be toxic or harmful. Always consult professional resources or experts for critical plant-related decisions.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGITIX LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of plants or vegetation
  • Personal injury from misidentified plants
  • Property damage
  • Loss of data
  • Loss of profits or revenue

Our total liability shall not exceed the amount you paid for the App or subscription in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless Digitix LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the App or violation of these Terms.

9. Third-Party Services

The App may contain links to or integrate with third-party services. We are not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is at your own risk.

10. Modifications to the App and Terms

We reserve the right to:

  • Modify, suspend, or discontinue the App at any time
  • Update these Terms at any time
  • Change subscription pricing with notice to existing subscribers

Continued use of the App after changes constitutes acceptance of the modified Terms.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

  • Your right to use the App will immediately cease
  • You may lose access to any data stored within the App
  • Active subscriptions may be cancelled without refund for Terms violations

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Digitix LLC regarding the use of the App and supersede any prior agreements.
